Training Recording Policy

  1. Purpose

Mystic Wellness Ltd is committed to protecting the integrity, confidentiality, and intellectual property of all training and courses delivered by the organisation, including Sound Bath, Gong Bath, Reiki, Meditation, and Drumming programmes.

This Recording Policy sets out the rules and expectations relating to the recording of live training sessions, online classes, workshops, and course materials. The purpose of this policy is to protect learners, tutors, and course content while ensuring transparency regarding when recording may or may not take place.

Training services provided by Mystic Wellness Ltd are intended solely for adults aged 18 years and over and are not offered to individuals under the age of 18.

This policy applies to all learners, tutors, staff, and participants attending any training or course delivered by Mystic Wellness Ltd, whether in person, online, or through blended learning formats.

By enrolling on any training or course, learners agree to comply with this Recording Policy.

This Policy forms part of the contractual terms governing participation in and access to training services provided by Mystic Wellness Ltd. No informal or verbal permission shall override this Policy unless confirmed in writing by Mystic Wellness Ltd.

This Policy should be read alongside our Privacy Policy, Online and Blended Learning Courses Policy, Confidentiality Policy, Safeguarding Policy, Acceptable Use Policy, Intellectual Property Policy, and Terms and Conditions.

  1. Scope

This Training Recording Policy applies to all training, educational, learning, mentoring, certification, practitioner development, workshops, webinars, online learning programmes, virtual classrooms, live events, recorded sessions, and related educational services provided by Mystic Wellness Ltd.

The Policy governs the recording, storage, use, management, access, retention, and protection of training recordings and related content created during or in connection with training activities.

This Policy applies to all individuals who participate in, attend, access, deliver, facilitate, support, administer, or otherwise engage with training services provided by Mystic Wellness Ltd, including but not limited to:

  • students and learners;
  • trainees;
  • practitioners;
  • trainers and facilitators;
  • guest speakers;
  • contractors;
  • employees; and
  • authorised users.

This Policy applies whether training is delivered:

  • in person;
  • online;
  • through virtual learning platforms;
  • through blended learning arrangements; or
  • through recorded educational content.

This Policy should be read alongside our Privacy Policy, Online and Blended Learning Courses Policy, Safeguarding Policy, Confidentiality Policy, Acceptable Use Policy, Terms and Conditions, and any other applicable Mystic Wellness Ltd policies and procedures.

  1. Eligibility

Mystic Wellness Ltd training courses, workshops, practitioner training programmes, mentoring programmes, certifications, online learning programmes, and related educational services are intended solely for individuals aged 18 years and over.

Mystic Wellness Ltd reserves the right to request proof of age or identity where reasonably necessary to verify eligibility for participation in training programmes.

By enrolling in, attending, accessing, or participating in any training programme, you confirm that:

  • you are at least 18 years of age;
  • you are legally capable of entering into a binding agreement;
  • the information you provide is accurate, complete, and up to date;
  • you understand that training sessions may be recorded in accordance with this Policy; and
  • you agree to comply with all applicable policies, procedures, safeguarding requirements, and participation standards.

Mystic Wellness Ltd does not provide training services to individuals under the age of 18.

Individuals under 18 years of age are not permitted to enrol in, attend, access, participate in, or appear within training sessions or training recordings.

If Mystic Wellness Ltd becomes aware that an individual under 18 has enrolled in, attended, accessed, participated in, or appeared within a training session or recording without authorisation, we reserve the right to remove, restrict, suspend, terminate, edit, or delete the relevant access, participation, recording, or content where appropriate.

Any personal data relating to individuals under 18 that is inadvertently collected will be processed in accordance with our Privacy Policy, Safeguarding Policy, UK GDPR, and the Data Protection Act 2018.

  1. Recording of Training Sessions (Online and In-Person)

To protect the confidentiality of learners, maintain a safe learning environment, and safeguard the intellectual property of Mystic Wellness Ltd, recording of any training session is strictly prohibited unless prior written permission has been granted by Mystic Wellness Ltd.

This applies to all training formats, including but not limited to:

  • live online classes, webinars, and virtual learning environments
  • in-person face-to-face sessions, workshops, retreats, classrooms, and events
  • blended learning or hybrid delivery models

The restriction applies to all forms of recording and capture technology, whether existing or emerging, including:

  • video recording
  • audio recording
  • photography
  • screen recording
  • screenshots
  • live streaming or broadcasting
  • covert or hidden recording devices
  • wearable or smart devices (including smartwatches, smart glasses, or similar technologies)
  • any other device capable of capturing, storing, transmitting, or reproducing session content

Learners must not record, photograph, livestream, or otherwise capture any part of any training session (online or in-person) under any circumstances without explicit prior written permission from Mystic Wellness Ltd.

No consent to recording may be implied by silence, participation, failure to object, or informal agreement between participants. Any recording is only permitted where explicit written permission has been granted by Mystic Wellness Ltd.

Learners are responsible for ensuring that no third party present (including guests or observers) records training content on their behalf.

This Policy applies equally to all current and future recording technologies, whether now known or developed in the future

  1. In-Person Training Safeguards

In-person training sessions involve experiential learning, personal reflection, group participation, and confidential sharing. As such, all participants must respect the privacy, dignity, and confidentiality of others at all times.

Unauthorised recording in physical training environments is strictly prohibited and may also constitute a breach of confidentiality, safeguarding requirements, data protection law, and intellectual property rights.

All participants are responsible for ensuring that any personal data shared during training is not captured, stored, or disclosed without lawful basis and appropriate consent.

All participants are responsible for ensuring that no third-party individual, guest, or accompanying person records training content on their behalf.

  1. Approval for Recording (Exceptional Circumstances Only)

Where written permission is granted (for example, accessibility needs or specific learning support requirements), any recording must:

  • not be shared, uploaded, distributed, or published in any form
  • not be copied, edited, or reproduced
  • not be used for commercial purposes or third-party access
  • be stored securely and deleted when no longer required

Permission will only be granted at the sole discretion of Mystic Wellness Ltd and may be withdrawn at any time.

No expectation of recording access should be assumed unless explicitly stated in writing as part of the course offer.

  1. Covert Recording and Device Control

Covert, hidden, or undisclosed recording is strictly prohibited.

Mystic Wellness Ltd reserves the right to require devices to be switched off, removed, or stored away where there is reasonable concern that unauthorised recording may occur.

  1. Live Streaming and External Broadcasting

Learners must not live stream, broadcast, or transmit any part of training sessions on social media platforms or any third-party service without written permission from Mystic Wellness Ltd.

  1. Breach and Enforcement

Unauthorised recording, including covert recording or live streaming, will be treated as a serious breach of this Policy and may result in:

  • removal from training
  • withdrawal of certification
  • suspension or termination of access
  • permanent exclusion
  • legal action where appropriate

Mystic Wellness Ltd reserves the right to request deletion of any unauthorised recordings where legally permissible and to take further action to protect learners, staff, and intellectual property.

No consent to recording may be implied by silence, participation, or failure to object.

Mystic Wellness Ltd reserves the right to refuse future participation or access to any individual found to have breached this Policy

  1. Mystic Wellness Ltd Right to Record Online Training

Mystic Wellness Ltd reserves the right to record online training sessions, webinars, workshops, and virtual classes where appropriate for operational, educational, safeguarding, or quality assurance purposes.

Recordings may be made for purposes including:

  • providing replay access to enrolled learners where this forms part of the course offer;
  • internal quality monitoring and training review;
  • safeguarding, dispute resolution and professional standards monitoring;
  • maintaining accurate records of training delivery;
  • compliance and audit purposes;
  • supporting learners who may require review access to specific teaching content.
  • staff training and supervision.

Where online sessions are recorded by Mystic Wellness Ltd, learners will be informed in advance or at the start of the session.

By participating in live sessions, you provide explicit consent to being recorded unless you choose to withdraw participation before the session begins.

Recordings may include presentations, demonstrations, shared screens, and participant contributions where relevant to the learning environment.

Recordings may capture video, audio, chat messages, and shared content where relevant.

Recordings may be edited, redacted, anonymised, or restricted where reasonably necessary to protect privacy, confidentiality, safeguarding requirements, legal obligations, or intellectual property rights.

If you do not consent to being recorded, you must notify us before the session or avoid participation in live recorded sessions where alternative options are not available.

Mystic Wellness Ltd reserves the right not to provide copies of recordings where doing so would compromise safeguarding, confidentiality, legal obligations, intellectual property rights, or the privacy of other participants.

  1. Recording Failure Disclaimer

Mystic Wellness Ltd does not guarantee that any session recording will be available, successfully captured, free from technical issues, or retained for any specific period unless expressly stated as part of the course offer.

Technical failures, internet outages, software issues, equipment malfunctions, platform disruptions, human error, or circumstances beyond our reasonable control may affect recording availability.

  1. Third-Party Platform Disclaimer

Training sessions may be delivered using third-party platforms, software, hosting providers, video conferencing services, learning management systems, cloud storage providers, or other service providers.

While Mystic Wellness Ltd takes reasonable steps to select appropriate providers, we are not responsible for interruptions, outages, technical failures, security incidents, service limitations, or other issues arising from third-party platforms beyond our reasonable control.

  1. No Reliance on Recordings

Recordings are provided as a supplementary learning resource only and do not replace attendance requirements, practical assessments, competency requirements, supervised practice, certification criteria, or course completion requirements where applicable.

  1. Accuracy of Recordings

Recordings reflect the content delivered at the time of recording and may not subsequently reflect updates to legislation, professional standards, guidance, policies, industry practice, or course materials.

Learners remain responsible for ensuring they rely upon the most current training materials and guidance provided by Mystic Wellness Ltd.

  1. Storage and Data Protection

Personal data contained within recordings will be processed in accordance with:

  • UK GDPR;
  • Data Protection Act 2018;
  • Privacy and Electronic Communications Regulations (PECR), where applicable.

All recordings are stored securely in accordance with UK GDPR and the Data Protection Act 2018.

Mystic Wellness Ltd will implement reasonable technical and organisational measures to protect recordings against unauthorised access, disclosure, alteration, loss, misuse, or destruction.

Access to recordings will be limited to authorised persons only, such as tutors, administrators, or enrolled learners where access has been intentionally provided.

Recordings will not be shared externally without lawful basis or participant consent unless required by law.

Recordings will be retained only for as long as reasonably necessary for the purpose for which they were created and will then be securely deleted.

Mystic Wellness Ltd reserves the right to remove, restrict, suspend, or revoke access to recordings at any time where reasonably necessary for safeguarding, confidentiality, legal compliance, intellectual property protection, operational requirements, or policy enforcement.

Recordings may be processed using third-party secure platforms acting as data processors under strict contractual agreements.

Client, learner, tutor, trainer, and participant recordings may be retained for such periods as are reasonably necessary to satisfy legal, regulatory, safeguarding, insurance, operational, contractual, educational, and business requirements

You have rights under UK GDPR including access, rectification, and objection, subject to legal limitations.

  1. Intellectual Property Rights

All recordings and content remain the intellectual property of Mystic Wellness Ltd.

Unauthorised use is strictly prohibited, including:

  • downloading;
  • redistribution;
  • reproduction;
  • editing;
  • AI training use;
  • or derivative works.

Content must not be used for training artificial intelligence systems, datasets, or automated learning tools without express written permission.

Breaches may result in legal action under the Copyright, Designs and Patents Act 1988.

Learners may not reproduce, duplicate, edit, distribute, publish, or commercially exploit any recordings or recorded materials without prior written consent from Mystic Wellness Ltd

Nothing in this Policy transfers ownership of any intellectual property rights to learners or participants.

Nothing in this Policy grants any licence, ownership right, assignment, transfer, or commercial usage right in relation to Mystic Wellness Ltd intellectual property except where expressly stated in writing.

  1. Confidentiality and Respect for Others

Learners must take reasonable steps to ensure that training sessions are attended from an environment that protects the privacy and confidentiality of other participants.

Where training involves personal sharing, therapeutic discussion, or group participation, learners must respect the privacy and dignity of others at all times.

You must not:

  • record other participants;
  • share personal disclosures;
  • publish group discussions;
  • identify individuals outside the session.

Learners must not screenshot, transcribe, or otherwise capture identifiable personal information shared during sessions.

Learners must not permit unauthorised individuals to view, listen to, access, or participate in training sessions or recordings without prior permission from Mystic Wellness Ltd.

Breach of confidentiality may also constitute a breach of UK GDPR where personal data is involved.

  1. Breach of Policy

Any breach of this Recording Policy, including unauthorised recording, sharing of recordings, or misuse of recorded content, may result in disciplinary action.

This may include:

  • formal warning;
  • immediate removal from a training session;
  • suspension or termination of access;
  • loss of certification;
  • permanent exclusion;
  • legal action;
  • reporting to authorities where required

Mystic Wellness Ltd reserves the right to determine appropriate action based on the seriousness of the breach.

Serious breaches involving data misuse, harassment, or intellectual property theft may be reported to law enforcement or regulatory bodies.

Mystic Wellness Ltd reserves the right to seek injunctive relief, recovery of losses, damages, legal costs, or other remedies available under law where a breach causes harm to the organisation, its learners, trainers, intellectual property, or reputation.

  1. Use of Artificial Intelligence (AI)

Any unauthorised AI-related use of training content may be treated as a serious breach of intellectual property rights and this Policy.

Learners must not upload, reproduce, process, analyse, distribute, or use any training recordings, materials, course content, transcripts, presentations, demonstrations, or educational resources for the purpose of training, developing, testing, improving, or operating artificial intelligence systems, machine learning models, automated learning tools, datasets, or similar technologies without prior written permission from Mystic Wellness Ltd.

  1. Changes to This Policy

We may update this Policy from time to time. Any changes will be posted on this page with an updated “Last Updated” date.

Continued participation in training after updates constitutes acceptance of the revised Policy.

  1. Learners Acknowledgement

By enrolling in any training or course with Mystic Wellness Ltd, learners acknowledge that they have read, understood, and agreed to comply with this Recording Policy.

By participating in training activities, learners acknowledge that recordings may contain proprietary educational content, teaching methods, materials, demonstrations, resources, and intellectual property belonging to Mystic Wellness Ltd.

Learners understand that unauthorised recording or misuse of recordings may result in disciplinary action and legal consequences.

Learners acknowledge that access to recordings may be withdrawn, restricted, suspended, or removed in accordance with this Policy.

This acknowledgement constitutes informed consent for recording where applicable and forms part of your contractual agreement with Mystic Wellness Ltd.

  1. Acknowledgement

This Policy survives completion, withdrawal, suspension, termination, or expiry of a learner’s participation in any training programme to the extent necessary to protect confidentiality, intellectual property rights, recordings, data protection obligations, and legal rights.

All practitioners, staff, contractors, and relevant students working with or representing Mystic Wellness Ltd. must read, understand, and agree to comply with this Recording Policy.

Failure to comply with this Policy may result in disciplinary action, termination of engagement, or legal consequences where applicable.
